These Terms of Service ("Terms") govern your access to and use of the Goldentag website, products, subscriptions, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By placing an order, creating an account, or subscribing to any Services, you represent and warrant that you meet these requirements.

2. Products and Services

Goldentag strives to ensure that product descriptions, images, pricing, availability, and other information are accurate.

However, we do not warrant that all information is complete, accurate, current, or error-free.

We reserve the right at any time to:

• Modify products or services;
• Change pricing;
• Correct errors or inaccuracies;
• Limit quantities;
• Discontinue products without prior notice.

Product images are provided for illustrative purposes only and actual products may vary.

Agricultural products, including olive oil, are natural products and may vary between harvests, production batches, growing conditions, and seasons.

Variations in color, aroma, flavor profile, texture, sediment, packaging appearance, and other naturally occurring characteristics do not constitute defects and shall not be grounds for refunds, replacements, or claims unless otherwise required by applicable law.

Goldentag makes no guarantee that any product will satisfy individual taste preferences, culinary expectations, or subjective quality assessments.

Personal dissatisfaction based solely on taste, aroma, texture, or other subjective preferences does not constitute a product defect.

Customers are responsible for storing products in accordance with any storage instructions provided on product packaging or product pages.

Goldentag shall not be responsible for product deterioration, quality changes, or reduced shelf life resulting from improper storage or handling after delivery.

3. Orders

All orders are subject to acceptance and availability.

Goldentag reserves the right, at its sole discretion, to:

• Refuse any order;
• Cancel any order;
• Limit quantities purchased;
• Request additional verification;
• Restrict purchases from specific customers, accounts, payment methods, or locations.

An order confirmation does not constitute final acceptance of an order.

Goldentag may cancel orders before shipment if fraud, pricing errors, stock shortages, technical issues, legal concerns, or other legitimate business reasons are identified.

4. Pricing and Payment

All prices are displayed in the applicable currency. Applicable taxes, duties, customs fees, and shipping charges may be added during checkout.

Customers are responsible for providing accurate payment information.

Goldentag reserves the right to refuse transactions or suspend services if payment cannot be successfully processed.

5. Subscriptions

Certain products may be offered on a recurring subscription basis.

By purchasing a subscription, you authorize recurring charges using your selected payment method until cancellation.Subscription cancellation is governed by the separate Cancellation & Subscription Termination Policy, which forms part of these Terms.

Customers are responsible for canceling subscriptions before the next billing date if they do not wish to renew.

6. Shipping and Delivery

Delivery times are estimates only and are not guaranteed.

Goldentag is not responsible for delays caused by:

• Carriers;
• Customs authorities;
• Government agencies;
• Weather conditions;
• Force majeure events;
• Circumstances beyond our reasonable control.

Unless otherwise required by applicable law, risk of loss and responsibility for products transfer to the customer upon delivery of the order to the shipping carrier. For consumers located in the European Union, the United Kingdom, or Switzerland, the risk of loss and responsibility for the products transfers to the customer only upon actual receipt of the order.

Customers are responsible for providing accurate shipping information.

Additional shipping costs resulting from incorrect information may be charged to the customer.

7. Returns, Refunds and Cancellations

Returns, refunds, and subscription cancellations are governed by our Cancellation & Subscription Termination Policy and any applicable Refund Policy.

Where permitted by law, payments already processed are non-refundable.

Nothing in these Terms limits mandatory consumer rights provided under applicable law.

For international shipments, customs duties, import taxes, VAT, brokerage fees, and other governmental charges may apply. By proceeding with your order, you acknowledge and agree that you will be responsible for these potential charges. Failure to pay these charges may result in the package being returned to us, at your expense.

Please note that orders shipped to Switzerland may be subject to Swiss import duties, customs clearance fees, and Swiss VAT, which are the sole responsibility of the customer.

8. Fraud Prevention

Goldentag reserves the right to investigate suspicious transactions and account activity.

Orders may be delayed, restricted, canceled, or refused if fraud, abuse, unauthorized activity, chargeback abuse, or other misuse is reasonably suspected.

Goldentag may request additional identity verification before fulfilling an order.

9. Chargebacks

Customers agree to contact Goldentag before initiating a chargeback or payment dispute whenever reasonably possible.

If a chargeback is initiated, Goldentag may provide transaction records, delivery confirmations, communications, fraud prevention data, and other relevant information to payment processors, financial institutions, and legal authorities.

Repeated or abusive chargebacks may result in account termination and refusal of future service.

10. Accounts

Customers are responsible for maintaining the confidentiality of their login credentials.

You are responsible for all activity occurring under your account.

Goldentag reserves the right to suspend or terminate accounts that violate these Terms or present security risks.

11. Intellectual Property

All content on the Services, including:

• Logos;
• Trademarks;
• Product designs;
• Images;
• Graphics;
• Text;
• Software;
• Branding;

is owned by or licensed to Goldentag and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or exploited without prior written consent.

12. User Conduct

You agree not to:

• Violate any law;
• Commit fraud;
• Interfere with the Services;
• Attempt unauthorized access;
• Use automated tools to scrape data;
• Impersonate another person;
• Distribute malware or harmful code.

Goldentag may suspend or terminate access for violations of these Terms.

13. Third-Party Services

The Services may integrate with third-party providers including payment processors, logistics providers, analytics services, advertising services, and Shopify.

Goldentag is not responsible for the actions, content, policies, or services of third parties.

Use of third-party services may be subject to additional terms and policies.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis.

Goldentag makes no warranties, express or implied, including warranties of:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Availability;
• Accuracy;
• Reliability.

Goldentag does not guarantee uninterrupted or error-free operation of the Services.

15. Limitation of Liability

To the fullest extent permitted by law, Goldentag shall not be liable for:

• Indirect damages;
• Consequential damages;
• Incidental damages;
• Special damages;
• Punitive damages;
• Loss of profits;
• Loss of revenue;
• Loss of business opportunities;
• Data loss.

In any event, Goldentag's total liability shall not exceed the amount actually paid by the customer for the product or service giving rise to the claim during the twelve (12) months preceding the event.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Goldentag, its directors, officers, employees, contractors, affiliates, and service providers from any claims, damages, liabilities, costs, or expenses arising from:

• Your breach of these Terms;
• Your misuse of the Services;
• Your violation of applicable law;
• Your infringement of third-party rights.

17. Force Majeure

Goldentag shall not be liable for failure or delay in performance resulting from circumstances beyond its reasonable control, including:

• Natural disasters;
• War;
• Terrorism;
• Government actions;
• Labor disputes;
• Power outages;
• Internet disruptions;
• Supply chain interruptions.

18. Privacy

The collection and processing of personal information are governed by our Privacy Policy, which forms part of these Terms.

19. Changes to the Services and Terms

Goldentag reserves the right to modify, suspend, or discontinue any part of the Services at any time.

We may update these Terms periodically. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, excluding its conflict of law rules.

If you are a consumer residing in the European Union, the United Kingdom, or Switzerland, nothing in these Terms shall deprive you of your mandatory consumer rights or the right to bring claims before the competent courts of your country of residence.

To the extent permitted by law, any dispute arising out of or relating to these Terms shall be subject to the jurisdiction of the competent courts of Cyprus.

Where mandatory consumer protection laws grant consumers the right to bring claims before the courts of their country of residence, those rights remain unaffected.

Nothing in these Terms shall limit any non-waivable statutory rights available to consumers under applicable consumer protection laws.
